Vermont law defines a mobile home park as any parcel of land which contains, or is laid out or adapted to accommodate more than two mobile homes. Contiguous parcels that contain a total of more than two mobile homes (or mobile home lots) are a mobile home park when they are owned or controlled by the same person. There are limited exceptions for seasonal parks and housing for farm employees.

What are the laws governing mobile home parks?

The mobile home park law is found in Chapter 153 of Title 10 of the Vermont Statutes. DHCD is authorized to enforce this statute in court, impose administrative penalties of up to $5,000, or refer violations to the Attorney General or State’s Attorney.

The Drinking Water and Groundwater Protection Division of the Vermont Agency of Natural Resources regulates water and septic systems under Chapter 64 of Title 10, and public water systems that serve mobile home parks. Design, layout and general requirements for mobile home park development may be regulated by local zoning ordinances, and by Act 250 in some cases.

Is a mobile home the same as a "manufactured house"?

Many people refer to "trailer" homes built before the HUD-code was established in 1976 as "mobile homes". Homes built under the HUD-code since 1976 are called  "Manufactured Homes", however, under Vermont law the terms mobile home and manufactured home are used inter-changeably.

Why do mobile home parks close?

Three quarters of Vermont's mobile home park lots are in parks that were built more than 40 years ago before most state permits and local zoning. Some of the reasons parks have closed include water or septic problems that it was unfeasible to repair, sale of the property for development or change of use, or because the owner decided to retire, or sell the property. In a few cases, parks were sub-divided into individual lots that were sold to the mobile home owners.

Flooding in 2011 damaged 17 parks, destroyed more than 125 mobile homes in those parks, and caused two of the flooded parks, with 6 and 11 lots each, to close. 

Park closure can be very disruptive to the affected families which is why Vermont has adopted laws providing 18 months advance notice of park closure, and in certain cases requiring the owner to offer the park for sale to the residents before closing.  

Are any new parks being built?

Seventeen new mobile home parks with a combined total of 208 lots have been built in Vermont since 1990. Three of these new parks were built by non-profit housing organizations to provide affordable housing in Brattleboro, Rutland, and Williamstown. Sometimes existing mobile home parks have also been expanded.

Are there any lots available?

The statewide vacancy rate in 2017 was 5.2%. Six out of ten Vermont's mobile home parks reported no vacant lots.

What is the average lot rent?

The state median lot rent for 2017 increased $9 to $334 per month from 2016. The median measures the midway point, meaning half the lots had rent higher than the median and half had lower rent. Rent varies greatly in different regions of the state and park to park. The median for nonprofit and resident owned (cooperative) parks for 2017 was $319. 

Is there a limit on rent increases?

There is no cap on mobile home park lot rent or rent increases. Leaseholders can dispute an increase that is more than the "mediation threshold" of one percent above the annual change in "CPI-Housing", as determined by the Department. In 2017, 130 parks increased the monthly lot rent by an average of about $11.50. Twenty proposed lot rent increases were more than the mediation threshold of 3.6% and one of those was disputed. For 2018 the mediation threshold is 3.9%.

Do most mobile home park residents own their home?

Yes, more than 90% of mobile homes in parks are owned by leaseholders, and approximately 9% are owned by the park owner. This "dual ownership" of owning a mobile home, but renting the lot from the park owner is one reason that the State has adopted laws to balance the rights of the park owner and the resident. In Vermont nearly 80% of all mobile homes are owner-occupied.

Are any mobile home parks owned by the residents?

Vermont has 11 resident owned mobile home parks and 47 parks owned by nonprofit housing organizations with a total of 2,479 lots. More than a third of Vermont's mobile home lots are owned by nonprofits and resident owned cooperatives. Purchase of a park by a nonprofit or cooperative often results in reduced lot rent increases over time, and in substantial investments in park improvements. Nonprofit and cooperative ownership can give residents more say in park management. No nonprofit or cooperative parks in Vermont have closed.

How many Vermonters live in mobile homes?

In 2015 there were an estimated 18,860 occupied mobile homes in Vermont; including mobile homes on their own land and in mobile home parks. In total, mobile homes equal 7.4% of all occupied housing units in Vermont. About 6,700 mobile homes are located in mobile home parks.
